Welcome to Ageless Wellness Spa. By accessing our website (agewellspa.com or booknaplesspa.com), booking an appointment, purchasing a membership, or using any of our services, you agree to be bound by these Terms and Conditions. Please read them carefully before proceeding.

If you do not agree to these Terms and Conditions, please do not use our website or services.

1. Acceptance of Terms

These Terms and Conditions constitute a legally binding agreement between you (“Client”) and Ageless Wellness Spa (“we,” “us,” or “our”). By using our services in any capacity, you confirm that you:

- Are at least 18 years of age, or have the consent of a parent or legal guardian
- Have read, understood, and agree to these Terms and Conditions
- Have read and agree to our Privacy Policy, which is incorporated herein by reference
- Are legally capable of entering into a binding contract

2. Services

Scope of Services

Ageless Wellness Spa offers a range of wellness and aesthetic services, including but not limited to: massages, facials, body treatments, wellness consultations, and spa packages. Specific services available are described on our website and may be updated at any time without notice.

Service Limitations

Ageless Wellness Spa is a wellness spa and not a medical facility. Our services are intended for relaxation, wellness, and aesthetic purposes. We do not diagnose, treat, cure, or prevent any medical condition. You should consult a licensed physician before receiving any services if you have health concerns or medical conditions.

Right to Refuse Service

We reserve the right to refuse, modify, or discontinue services to any individual at our sole discretion, including but not limited to situations where:

A client’s health condition may be contraindicated for a requested service
A client is under the influence of alcohol or drugs
A client exhibits inappropriate, threatening, or disrespectful behavior toward staff or other clients
A client fails to disclose relevant health information

3. Appointments & Cancellations

Booking Appointments

Appointments may be booked online at agewellspa.com or booknaplesspa.com, by calling +1 239-241-5718, or in person at our location. Appointments are confirmed upon receipt of booking confirmation.

Cancellation Policy

We require a minimum of 24 hours’ notice to cancel or reschedule an appointment. Cancellations made with less than 24 hours’ notice, or failure to appear for a scheduled appointment, may result in:

A cancellation fee of up to 50% of the scheduled service value
Forfeiture of a prepaid session for membership holders
Temporary suspension of booking privileges for repeat no-shows

Late Arrivals

If you arrive late for your appointment, your service time may be reduced to avoid impacting subsequent clients. Full service fees will still apply. We recommend arriving at least 10 minutes before your scheduled appointment.

Our Right to Cancel

We reserve the right to cancel or reschedule appointments in the event of staff illness, facility issues, or other circumstances beyond our control. We will make reasonable efforts to provide advance notice and offer an alternative appointment time.

4. Memberships & Packages

Membership Terms

Membership plans are offered on a recurring billing basis. By enrolling in a membership, you authorize Ageless Wellness Spa to charge the applicable membership fee to your payment method on the agreed billing cycle (monthly or annual, as selected).

Cancellation of Membership

Memberships may be cancelled with 30 days’ written notice prior to the next billing date. Cancellation requests must be submitted via email to info@agewellspa.com or in writing at our location. No refunds will be issued for partially used billing periods.

Membership Freeze

Members may request to pause their membership for a maximum of 60 days per calendar year due to medical reasons, travel, or other extenuating circumstances. Freeze requests must be submitted in writing at least 7 days in advance.

Prepaid Packages

Prepaid service packages are non-refundable and non-transferable. Packages must be used within 12 months of the date of purchase unless otherwise specified. Expired packages will be forfeited without refund.

5. Payment & Pricing

Payment Methods

We accept major credit and debit cards, cash, and other payment methods as displayed at the time of purchase. Payment is due at the time of service unless otherwise agreed in writing.

Pricing

All prices are listed in U.S. dollars and are subject to change without notice. Taxes and gratuities are not included in service prices unless otherwise stated. We encourage clients to review current pricing on our website or by contacting us prior to booking.

Disputes & Chargebacks

If you believe a charge on your account is incorrect, please contact us at info@agewellspa.com within 30 days of the transaction date. We will investigate and resolve legitimate billing disputes in a timely manner. Initiating a chargeback without first contacting us may result in suspension of your account.

6. Health & Safety

Health Disclosure

For your safety and the safety of our staff, you are required to disclose any medical conditions, allergies, injuries, or medications that may affect your ability to receive services. Failure to disclose relevant health information releases Ageless Wellness Spa from liability for any adverse reactions or injuries that may result.

Contraindications

Certain services may be contraindicated for clients who are pregnant, have specific medical conditions, or are recovering from surgery or illness. Our staff will advise you of any contraindications at the time of booking or before your service begins. You are responsible for consulting your physician if you have any concerns.

Assumption of Risk

By receiving services at Ageless Wellness Spa, you acknowledge that all wellness and spa services carry inherent risks. You voluntarily assume all such risks and agree to hold Ageless Wellness Spa harmless for any injury, discomfort, or adverse reaction that may occur.

7. Client Conduct

We are committed to providing a peaceful, professional, and welcoming environment for all clients and staff. As a client, you agree to:

Treat all staff and other clients with courtesy and respect
Refrain from using loud, offensive, or inappropriate language on our premises
Refrain from bringing minors under 16 years of age into service areas without prior written approval
Follow all posted policies, safety guidelines, and staff instructions
Silence or turn off mobile devices during services

Violation of our conduct standards may result in termination of your session without refund, and may result in a ban from our facility.

8. Intellectual Property

All content on agewellspa.com and booknaplesspa.com, including text, graphics, images, logos, and service descriptions, is the property of Ageless Wellness Spa and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or use our content without our prior written consent.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Ageless Wellness Spa, its owners, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

Your use of or inability to use our services or website
Any adverse reaction, injury, or harm resulting from services received
Unauthorized access to or alteration of your personal data
Any third-party conduct or content linked to our services

Our total liability to you for any claim shall not exceed the amount you paid for the specific service giving rise to the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Ageless Wellness Spa and its officers, employees, and agents from any claims, liabilities, damages, costs, or expenses (including reasonable attorney’s fees) arising out of your use of our services, your violation of these Terms, or your violation of any applicable law or third-party rights.

11. Privacy

Your use of our services is also governed by our Privacy Policy, available at agewellspa.com and booknaplesspa.com. By using our services, you consent to the collection, use, and sharing of your information as described in the Privacy Policy.

12. Governing Law & Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any dispute arising under these Terms shall first be subject to good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Collier County, Florida, in accordance with the American Arbitration Association rules. You waive your right to participate in any class action lawsuit or class-wide arbitration.

13. Changes to These Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective upon posting to our website. Your continued use of our services after any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.

14. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
